xAlice team announces the "I am xAlice Art License".

Purpose of xAlice Art License

Comics, illustrations, animations, movies, novels, games, etc.

We have lived through many wonderful pictures, stories, and technologies in our lives. Those wonderful treasures have definitely enriched our time spent.

We salute the creators of such content and are deeply grateful to the expanding "culture" that surrounds us, including ourselves, who have enjoyed and enriched our lives with it.

Our NFT collection "I am xAlice" ("xAlice") aims to support the creative activities of each creator and protect the rights of the holders, thereby creating a vibrant culture and economic zone centered on digital art.

Subject of xAlice Art License

This License covers the creative activities of individual creators and of small teams. A different license is applied for activities by companies, organizations or teams of a certain, larger size (generally more than 5 members). In these cases, please contact the xAlice team in the support channel of xAlice's official Discord.

The activities listed below are beyond the intended use of the xAlice Art License. Please contact the xAlice team and get approval before you start those activities.

Any fundraising activities in order to build your applications and services
Any NFT projects providing generative NFT collectible
Any activities offering things that could be considered securities

Hereinafter, when the term "NFT" or "NFTs" is used without any specification, it refers to NFTs belonging to the xAlice collection.

About xAlice collections and xAlice Origin collections

xAlice Collection is a generative NFT collection with randomly selected parts.
xAlice Origin collection is a NFT collection with coordinated parts by the original illustrator "Chon*".
xAlice Collection and xAlice Origin Collection are two different collections with different smart contracts, prices, and sales methods.
Artwork and designs from the xAlice Origin Collection will be used in official merchandise planned and produced by the xAlice team, as well as in official comics and animations.
Some NFTs from the xAlice collection may be migrated to the xAlice Origin collection for future events, etc.

Definition of derivative works

Creation, display, delivery and distribution of illustrations, comics, books, videos, magazines and any other form of works, not limited to those listed here.
Creation, display and delivery of figurines, dolls, cosplay and any other forms of three-dimensional works.

Fundamental Rules

Provide appropriate credit when using xAlice content.
To take sufficient care not to damage the image of xAlice and NFT art as a whole.
You are welcome to create derivative works and use them commercially within certain limits, provided that you abide by the above rules.
If your cumulative earnings exceed the limit, please contact the xAlice team.

Based on the Fundamental rules, the rights of the xAlice Collection and xAlice Origin Collection holders are hereby established as follows.

Rights of NFT holders

For the xAlice Collection and xAlice Origin Collection NFT you own, you are free to do the following activities.

Use as material for profile pictures and banner images for SNS, etc.
Copying or sharing with appropriate credit for xAlice.
Creation, remixing, or modification of derivative works for commercial or noncommercial purposes until the cumulative revenue reaches a threshold of 42,000 US dollars. (Whether intended for commercial or noncommercial use, the original artwork can be used as it is.)

Rights of non-NFT holders

For all NFTs in xAlice Collections and xAlice Origin collections, non-NFT holders are available to perform activities under limitations provided below.

Copying or sharing with appropriate credit for xAlice.
Creation, remixing, or modification of derivative works for commercial or noncommercial purposes until the cumulative revenue reaches a threshold of 4,200 US dollars. (non-NFT holders are not permitted to use the original artwork as is or as material.)

Rights of xAlice team

The xAlice team reserves the right to use NFT art and derivative art from the xAlice collection and xAlice Origin Collection for promotional purposes without any limitation.
The xAlice team reserves the right to commercially use NFT art and derivative art from the xAlice Origin collection upon entering into a license agreement with the holder.

Prohibited items for derivative creation activities

Any content that deviates from xAlice's image and damages the reputation of the collection.
Any content that violates the public order and morality or is discriminatory in any form.
Any content that has little or no creativity such as directly copying, scanning, sampling, or tracing NFT artworks including illustration, video, voice, song and the like. Except in the case where the NFT holder uses NFTs owned by himself/herself.
Any activity representing oneself as a xAlice official.
Any activity that is in violation of the purposes and rules of this license.
Any content that infringes upon the rights of others.

How to credit

If you are publishing a xAlice collection and xAlice Origin collection derivative work as an NFT, it is not necessary to include a credit to xAlice in the accompanying media files (illustrations, videos, etc.) We encourage you to include a credit in the description section of the NFT.
If you publish or provide derivative works in a form other than NFTs, please include a credit to xAlice in a place that is easily visible and accessible to viewers and purchasers.
Recommended crediting methods include "Licensed by xAlice" and "Derivative art of xAlice".

Case study about the art license

Acceptable use cases

The owner of the xAlice collection and xAlice Origin collection NFT creates derivative illustrations of the NFT he/she owns and sells them as NFTs.
The owner of the xAlice collection and xAlice Origin collection NFT edits the artwork contained in the NFT and sells it as an NFT.
The owner of the xAlice collection and xAlice Origin collection NFT uses the artwork "as is" to produce and sell merchandise such as T-shirts, etc.
A creator creates a derivative artwork of the xAlice collection and xAlice Origin collection NFT that he/she does not own and then mints that artwork as an NFT and sells.
A creator creates a derivative artwork of the xAlice collection and xAlice Origin collection NFT that he/she does not own and then produces and sells merchandise such as T-shirts, etc.
A creator creates derivative artwork of the xAlice collection and xAlice Origin collection NFT that he/she does not own, and publishes the artwork on Pixiv/Twitter, etc.

Not acceptable use cases

A creator uses the original artwork contained in the xAlice collection and xAlice Origin collection NFT that he/she does not own and "as is" produces merchandise such as T-shirts, etc and sells them.
A creator retouches an artwork contained in the xAlice collection and xAlice Origin collection NFT that he/she does not own and sells it as an NFT.

You are free to create derivative works or sell merchandise without the consent of the xAlice team as long as you do not violate this License.
